29 CFR 1926.451(g)(1)(i):     Each employee on a boatswains' chair, catenary scaffold, float scaffold, needle beam scaffold, or ladder jack scaffold was not protected by a personal fall arrest system:    a) On or about 12/17/12, on construction site at the Sunoco Food Mart, 211 Niagara St., Buffalo, NY:  An employee of a subcontractor was on the narrow aluminum "pik" of a ladder jack scaffold erected on the south side of the building. The employee was installing soffits, and was exposed to a fall of approx. 15 ft. to the ground. The employee was wearing a full body harness, but was not tied off to an anchor point, and no other fall protection system was utilized.    NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.501(b)(1):     Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.    a) On or about 12/17/12, on construction site at the Sunoco Food Mart, 211 Niagara St., Buffalo, NY: An employee was exposed to a potential fall of 8 ft. while walking along the top edge of the "cooler" at the north end inside the building. No guardrails or other fall protection system was utilized to protect the employee.    NO ABATEMENT CERTIFICATION REQUIRED
