29 CFR 1926.102(a)(1):  Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:    a.  On or about December 17, 2012, at the east side of the building, an employee using an air nail gun to install water proofing underlying material was not wearing eye protection, exposing himself to being struck by flying debris or nails.

29 CFR 1926.501(b)(13):  Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a.  On or about December 17, 2012, on a 5:12 pitch roof, employees installing water proofing underlying material were not protected from a 9 feet fall hazard by the use of conventional fall protection system or alternative fall protection measures.

29 CFR 1926.1053(b)(4):  Ladders were used for purposes other than the purposes for which they were designed:    a.  On or about December 17, 2012, at the east side of the building, two employees used the fly section of a 24 feet aluminum extension ladder that was not designed to be used as a single ladder, exposing themselves to a 9 feet slip fall hazard.
