29 CFR 1910.95(b)(1): When employees were subjected to sound exceeding those listed in Table G-16, feasible administrative or engineering controls were not utilized: This violation occurred on December 27, 2012, when the employer had not utilized administrative or engineering controls for employees exposed to noise that exceeded an 8-hour TWA of 90 dBA, based on a 90 dB threshold: a) In the peeling department, a trim line operator was exposed to continuous noise levels at 893% of the permissible 8-hour TWA. The equivalent level of 893% is approximately 105.8 dBA. Sampling was performed for 474 minutes during one shift. Zero exposure was assumed for the unsampled period of 6 minutes. b) In the peeling department, a trim line operator was exposed to continuous noise levels at 862% of the permissible 8-hour TWA. The equivalent level of 862% is approximately 105.5 dBA. Sampling was performed for 453 minutes during one shift. Zero exposure was assumed for the unsampled period of 27 minutes. c) In the peeling department, a trim line operator was exposed to continuous noise levels at 929% of the permissible 8-hour TWA. The equivalent level of 929% is approximately 106.1 dBA. Sampling was performed for 479 minutes during one shift. 29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.95(c) through (o) whenever employee noise exposures equaled or exceeded an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: This violation occurred on December 27, 2012, when the employer had not administered a hearing conservation program for employees exposed to noise that exceeded an 8-hour TWA of 85 dBA, based on an 80 dB threshold: a) In the peeling department, a trim line operator was exposed to continuous noise levels at 894% of the permissible 8-hour TWA. The equivalent level of 894% is approximately 105.8 dBA. Sampling was performed for 474 minutes during one shift. Zero exposure was assumed for the unsampled period of 6 minutes. b) In the peeling department, a trim line operator was exposed to continuous noise levels at 863% of the permissible 8-hour TWA. The equivalent level of 863% is approximately 105.5 dBA. Sampling was performed for 453 minutes during one shift. Zero exposure was assumed for the unsampled period of 27 minutes. c) In the peeling department, a trim line operator was exposed to continuous noise levels at 930% of the permissible 8-hour TWA.
