OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees: On or about November 29, 2012, an employee was in the process of placing chicken into the Henny Penny pressure cooker which had a damaged counterweight mechanism for the units lid. When the lid structure was lowered by the handle, the mechanism that supported the lid structure failed. The employee received burns to his stomach and hands when the lid structure fell into the hot oil. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the Henny Penny Pressure Cooker technical manual, if the lid becomes difficult to operate, stop using the pressure cooker and remove from service. Conduct training for employees on the safe operating practices of the equipment in accordance with the manufacturers instruction in the technical manual and enforce those practices. When the operation of the pressure cooker lid counterweight mechanism of the unit does not balance the weight of the lid system that helps in the raising and lowering of the lid, immediate discontinue use and call for service to replace the cables.

29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): A hazard assessment was not performed to ensure that employees operating the Henny Penny Pressure Cooker, operating at a temperature of approximately 350 degrees, were protected from burns from splashed oils. One of the two cables on the machine supporting the structure that holds the chicken, was broken. The other cable broke while an employee was lowering the product into the oil, which splashed oil on them resulting in receiving burns and was not wearing safety heat resistant apron and gloves.

29 CFR 1910.132(f)(1)(i): The employer did not provide training to each employee who is required by this section to use PPE on knowing when PPE is necessary: a) Employees operating the Henny Penny Pressure Cooker, operating at a temperature of approximately 350 degrees, are exposed to burn hazards from the hot oil within the cooker. Employees were not provided with adequate training that would have given them the proper knowledge to know when to use protective equipment and the proper type such as but not limited to heat resistant aprons and gloves.
