29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):     On or about December 18, 2012, on the North side of SW 36th St., employees were spreading gravel in order to settle piping at the bottom of an excavation with a vertical wall on one side and a sloped wall on the other side. The Excavation was approximately 7 feet deep, 6 feet wide and 28 feet in length. The site was excavated in previously disturbed soil with no protective system exposing the employees to cave in hazards.      THE YANTIS COMPANY WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.652(A)(1), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 314305095, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON 24 MARCH 2011, WITH A FINAL ABATEMENT DATE OF  19 MARCH 2011, WITH RESPECT TO A WORKPLACE LOCATED AT MEDIATOR PATH & ROCKET LANE, CONVERSE TX.
