29 CFR 1926.652(a)(1):   Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or(c).  The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees from the horizontal):    a) Jobsite,  202 - 216 Shawmont Ave., Philadelphia - Employees in an excavation approximately 8' deep and 6' wide on the eastern side of a bridge were not protected by an adequate protective system, exposing the employees to crushing, struck-by and cave-in hazards.  Observed on or about 12/17/12.     b) Jobsite,  202 - 216 Shawmont Ave., Philadelphia - Employees in an excavation approximately 12' deep and 6' wide on the western side of a bridge were not protected by an adequate protective system, exposing the employees to crushing, struck-by and cave-in hazards.  Observed on or about 12/17/12.     NOTE:  Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder:      a) Jobsite,  202 - 216 Shawmont Ave., Philadelphia - A portable ladder used by employees to climb onto the arch of the bridge from the east side, did not extend at least 3 ft. above the arch, exposing employees to possible injuries.  Observed on or about 12/17/12.     b) Jobsite,  202 - 216 Shawmont Ave., Philadelphia -  A portable ladder used by employees to climb out of the excavation on the east side was shorter than the wall of the excavation, exposing employees to possible injuries.  Observed on or about 12/17/12.       NOTE:  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement.
