OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards:   On or about 12/18/12 - At 15755 AL Highway 68, Crossville, AL, the Lull forklift boom and load were not lowered before the operator left the seat then stood on the operator's step and leaned into the cab to adjust the new seat's nuts and bolts.

29 CFR 1926.451(a)(6): Scaffolds were not constructed in accordance with the design by a qualified person:  (a) On or about 12/18/12 - At 15755 AL Highway 68, Crossville, AL, the self-contained adjustable EZ Heavy Duty Commercial Tower Scaffold was not constructed in accordance with the design in that the bridges were not installed with the crown of the truss facing up.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91m) wide:  (a) On or about 12/18/12 - At 15755 AL Highway 68, Crossville, AL, employees were working on scaffold that was not guyed, tied and/or braced according to the scaffold manufacturer's recommendations in that there were no 2x4 timbers, putlogs or scaffold members placed between the masonry wall and the scaffold to protect the scaffold from tipping into the wall due to compressive loads.

29 CFR 1926.451(g)(1)(iv): Each employee on a self-contained adjustable scaffold shall be protected by a guardrail system (with minimum 200 pound toprail capacity) when the platform is supported by the frame structure, and by both a personal fall arrest system and a guardrail system (with minimum 200 pound toprail capacity) when the platform is supported by ropes:  (a) On or about 12/18/12 - At 15755 AL Highway 68, Crossville, AL, employees were exposed to a fall hazard of approximately 25 feet while removing concrete block from the pallet which was set down on the scaffold platform located outside of the guardrail system.  The mid rail was removed and employees had to reach through and under the top rail in order to retrieve the concrete block and were exposed to a fall hazard when the level of concrete block was one tier high.
