29 CFR 1926.451(b)(1): Platform(s) on all working levels of scaffolds, were not fully planked or decked between the front uprights and guardrail supports such that the space between adjacent units, and the space between the platform and the uprights is not decked as fully as possible:     a) West Side of the Building - A carpenter was observed on a tubular welded frame scaffold that was not fully decked exposing him to a 33 foot fall hazard onto the concrete sidewalk below, on or about December 18, 2012.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.      a) West Side of the Building - A carpenter was observed on a tubular welded frame scaffold that was not equipped with a ladder for egress exposing him to a 33 foot fall hazard onto the concrete sidewalk below, on or about December 18, 2012.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.451(g)(3): In addition to meeting the requirements of 1926.502(d), personal fall arrest systems used on scaffolds were not attached by lanyard to a vertical lifeline, horizontal lifeline, or scaffold structural member. Vertical lifelines were not used when overhead components, such as overhead protection or additional platform levels, are part of a single-point or two-point adjustable suspension scaffold:    a) West Side of the Building - A carpenter was observed with a nylon rope instead of a lanyard, tied to the D-ring of the full body harness as part of his personal fall arrest system exposing him to a 33 foot fall hazard onto the concrete sidewalk below, on or about December 18, 2012.    Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:    a) 3rd Floor, front Room, West Window - A carpenter was observed using a window for accessing an exterior scaffold where the window sill measured 29 inches above the floor exposing him to a slip and fall hazard, on or about December 18, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.1052(c)(1)(i): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with at least one handrail:    a) Between 1st & 2nd floors and 2nd & 3rd Floors - A foreman and a carpenter were observed using the stairs between various floors was not equipped with a standard handrail exposing him to a 20 foot hazard, on or about December 18, 2012.    Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
