Employees were exposed to hazards caused by inexperienced forklift truck operator.

29 CFR 1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied: On or about November 1, 2012, employees were observed working from a homemade wood platform mounted to a forklift truck and was raised to a height approximately 27 feet high. The wood platform was observed not properly secured to the forklift truck. Employees were exposed to fall hazards.

On or about November 1, 2012, at the job site employees were observed working on a walking/working unprotected side or edge of a building more than 6 feet high to the lower levels. The employees were not wearing personal fall arrest system or having any other type of fall protection systems provided. The employees were exposed to fall hazards.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: On or about November 1, 2012, at the jobsite employees were working from a homemade wood platform which was mounted on an all-terrain forklift truck and raised to a height approximately 27 feet high. The employer did not have a written approval from the forklift truck manufacturer to allow such addition/modification to the forklift. The forklift truck or the platform could collapse and injure the employees.
