29 CFR 1926.451(b)(2): Scaffold platforms and walkways were not at least 18 inches wide:    The employer does not ensure all scaffold platforms are at least 18 inches wide to prevent employee injury. This violation was observed on or about December 17, 2012, when an employee was exposed to a fall hazard while working on a scaffold platform that was 8 inches wide.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed an maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:    The employer does not ensure that a guardrail system is installed on all working levels of scaffolds to prevent employee injury. This violation was observed on or about December 17, 2012, when an employee was exposed to a fall hazard while on a working level of a scaffold without a guardrail system in place.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all scaffolds are constructed an maintained in accordance with 29 CFR 1926.451 or 29 CFR 1926.452.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     The employer does not ensure that employees are protected from falling while working at heights greater than six feet. This violation was observed on or about December 17, 2012, when an employee was exposed to a fall hazard while installing plywood to the side of a residential home without any means of fall protection.    Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees performing construction activities at heights greater than six feet are protected from falling.
