29 CFR 1926.95(a):      Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition, wherever it was necessary by reason of hazards of process or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:    On or about December 19, 2012, an employee was exposed to a struck by hazard while operating a JLG Forklift, Model 644E-42, without wearing the required seatbelt.

29 CFR 1926.451(e)(1):      When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used:    On or about December 19, 2012, employees are exposed to a fall hazard of approximately 36 feet in height to the concrete ground level below while using the scaffold end-frames to access the 6th level of the scaffold.

29 CFR 1926.451(g)(1):      Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:    On or about December 19, 2012, employees are exposed to a fall hazard of approximately 30 feet in height to the concrete ground below while performing masonry work from a tube and frame scaffolding.
