OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from climbing racking systems. Location: Warehouse area located at 4 Wright Street, New Bedford, MA Employees were exposed to fall hazards up to 10 feet while climbing up on the racking system to retrieve material.

OSH ACT of 1970 Section (5)(a)(1): 29 CFR Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls from riding a wooden pallet on a forklift in order to get material off of racking system. Location: Warehouse area located at 4 Wright Street, New Bedford, MA Employees were exposed to fall hazard while being lifted with a forklift with a wooden pallets on the forks in order to get material off of shelves.
