29 CFR 1926.28(a):     The employer is responsible for requiring the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions or where this part indicates the need for using such equipment to reduce the hazards to the employees.      (a) Construction Site- On or about December 14, 2012 one employee was operating a JLG Lull Model 1044C-54 Series Forklift (serial no. 539894RA) without wearing seatbelt on uneven muddy ground.

29 CFR 1926.451(b)(1):     Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows:    (a) First Tower, Leftside - On or about December 14, 2012 one employee was exposed to a fall hazard due the scaffold not being fully decked or planked. The employee was exposed to falling 40 feet to concrete.      (b) First Tower, Backside - On or about December 14, 2012 one employee was exposed to a fall hazard due the scaffold not being fully decked or planked. This section of the scaffold only had one plank installed. Employee was exposed to falling 20 feet to concrete.

29 CFR 1926.451(e)(1):     When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    (a) First Tower, Backside - On or about December 14, 2012 six employees were exposed to a fall hazard while climbing on a welded metal frame scaffold that did not a means of access or egress. No ladder was installed to get on or off the scaffold. The scaffold was 40 feet above concrete.

29 CFR 1926.451(g)(1):     Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.    (a) First Tower, Backside - On or about December 14, 2012 one employee was exposed to a fall hazard while standing on a welded metal frame scaffold. Guardrail system or safety net system or personal fall arrest was not provided to prevent employee faalling 40 feet to ground.

29 CFR 1926.454(a):     The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    (a) Barriga Construction, LLC- On or about December 14, 2012 employees were exposed to a fall hazards up to 40 feet while working on scaffolds. Employees were not provided training on how to recognize and minimize fall hazards associated scaffolds.
