29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system, nor was an alternative fall protection measure provided:    (a)Rodriguez Construction Org, LLC @ 4295 N. Broadway Ave., Boulder, CO 80304: On and before December 18th, 2012, the exposing employer did not ensure employees were protected from injury, in that employees engaged in framing activities on a roof were exposed to falls from approximately 10 feet without the use of a fall protection system.

29 CFR 1926.451(c)(2)(iv):  Front-end loaders and similar pieces of equipment shall not be used to support scaffold platforms unless they have been specifically designed by the manufacturer for such use:     (a) Rodriguez Construction Org, LLC @ 4295 N. Broadway Ave., Boulder, Colorado 80304:  On and before December 18th, 2012, the creating and exposing employer did not ensure that a platform on a rough terrain forklift, used to raise employees, had been approved by the forklift manufacturer for such use.  The employer used sheets of plywood resting on the forks of a rough terrain forklift manufactured by Gehl RSG-34, to raise an employee to the roof of a custom home.  This use resulted in an unstable platform, and the condition exposed the employee to a fall hazard approximately 15 feet from the platform to the ground.                                                               OR IN THE ALTERNATIVE    29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design:    (a) Rodriguez Construction Org, LLC @ 4295 N. Broadway Ave., Boulder, Colorado 80304:  On and before December 18th, 2012, the creating and exposing employer did not ensure that a platform on a rough terrain forklift, used to raise an employee, had been approved by the forklift manufacturer for such use.
