29 CFR 1926.304(d): Portable, power-driven circular saw(s) were not equipped with a guard above and below the base plate or shoe:    At the job site on December 20, 2012, employees were using circular saws with the guards shimmed when framing and installing hardy plank, exposing the employees to amputation hazards:       a)  a Makita circular model 5007MG unguarded.       b)  a Craftsman circular saw model Evolv unguarded.       c)  a Kobalt circular saw; model K15CS-06A unguarded.

29 CFR 1926.451(e): When scaffold platforms were more than 2 feet (0.6m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair ladders (scaffold stairway/towerrs), stairway-type ladders (such as ladder stands) ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surfaces were not used. Cross braces were used as a means of access.      At the job site on December 20, 2012, employees did not have a ladder or other portable suitable method of access to the scaffold working area; instead the employees accessed the job built scaffold by climbing out of windows, exposing employees to fall hazards.

29 CFR 1926.454(a): The employer did not have each employee who performed work on a scaffold be trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used, and to understand the procedures to control or minimize those hazards.    At the job site on December 20, 2012, employees were working from a scaffold and did not have any training. These employees were working 18 foot above the next level with out fall protection, exposing them to falls from heights.
