29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about December 21, 2012, an employee observed working on a 4:12 pitch roof without utilizing a proper fall protection system. The employer did not instruct each employee in the recognition and avoidance of unsafe conditions. The employee was exposed to fall hazard of approximately 21-feet to the ground.

The employee was exposed to fall hazard of approximately 21-feet to the ground. RUBIO CONSTRUCTION & REMODELING WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501 (B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 307265363, CITATION NUMBER 01, ITEM NUMBER 001 AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 08, 2009, WITH RESPECT TO A WORKPLACE LOCATED AT 3216 MUDDY POINT, EL PASO, TX 79928.
