29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided. (a)Smiley, Inc. @ 2955 4th Street, Boulder, CO 80302: On and before December 18th, 2012, the exposing employer did not ensure that fall protection systems were utilized by employees engaged in the installation of flashing while working and walking at the unprotected edges of a roof on a single-family home. An employee was not utilizing a fall protection system. Employees were exposed to fall hazards of approximately 15'.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards: (a)Smiley, Inc. @ 2955 4th Street, Boulder, CO 80302: On and before February 14, 2011, the exposing employer did not ensure that each employee engaged in the installation of flashing on the roof of a single-family home, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The employer did not provide training on the simple saver fall protection system involving it's limitations and use. The condition exposed employees to the hazard of falling from an elevation of approximately 15'.
