29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:    (a)Eligio Martinez Hernandez Construction, LLC @ 1275 Tamarck St., Boulder, CO 80302:  On and before December 18th, 2013, an employee was working from the basket of an articulating boom aerial lift with no fall protection.  This hazard exposed the employee to a fall of approximately 15 feet.    Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part 1926.502(d) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided.       (a)Eligio Martinez Hernandez Construction, LLC @ 1275 Tamarack St., Boulder, CO 80302: On and before December 18th, 2012, the exposing employer did not ensure that fall protection systems were utilized by an employee engaged in deck construction activities while working at the unprotected edges of the second story deck measured at 13'7' on a single-family home under construction. An employee was not utilizing a fall protective system. This condition exposed an employee was exposed to fall hazard of approximately 13'7".    Eligio Martinez Hernandez Construction, LLC was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.501(b)(1) which was contained in OSHA Inspection Number 311910277, Citation Number 1, Item 1a, issued on February 17th, 2009, and became Final Order on March 11th, 2009, with respect to a workplace located at 720 Granite St., Frisco, CO 80442.
