29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)Martin Marietta Materials, Inc. @ 444 E. 19th Ave., Denver, CO 80203:   On and before December 4th, 2012, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. A quality control employee was staging and backing concrete trucks up to the concrete pump truck in a confined area.  Employees on-site were permitted to work in areas where struck-by and caught-in-between hazards existed. The employer did not take the necessary steps to ensure the quality control employee was protected from struck-by or caught-in-between hazards involving the process of moving concrete trucks to the concrete hopper in a constricted area. The condition exposed an employee to crushing hazards as a result of being pinned between the chute of a backing concrete truck and the ladder of a stationary truck.      Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulations(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury:    (a)Martin Marietta Materials, Inc. @ 444 E. 19th Ave., Denver, CO 80203:  On and before December 4th, 2012, the employer did not ensure employees were instructed in the recognition and avoidance of unsafe conditions while performing quality control responsibilities associated with large concrete pours. On December 4th, 2012, one employee was pinned between the ladder of a staged concrete truck and the concrete chute of another truck that was backing up to the concrete pump truck. The employer did not instruct the quality control employee and third party concrete driver on the hazards or safe operating procedures to be used when backing up the concrete truck to the concrete pump truck in a constricted area. The employer did not provide training regarding struck-by or caught-in-between hazards associated with staging and backing up concrete trucks for a concrete pour. This condition exposed the Martin Marietta Materials, Inc. employee to a struck-by or crushing hazard.
