29 CFR 1910.178(l)(4)(iii):     An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years.    On or about 12/18/2012, employees from Pasha Distribution Services located at 8050 Veterans Memorial  Parkway, St. Peters, MO 63376 were allowed to operate a Clark propane forklift (unavailable serial number) without having the required three year evaluation.  The last evaluation was conducted on 4/22/2009.

29 CFR 1910.215(b)(9):     Safety guards for abrasive machinery, where the operator stands in front of the opening was constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch.     On or about 12/18/2012, employees from Pasha Distribution Services located at 8050 Veterans Memorial Parkway, St. Peters, MO 63376 were using a Delta  bench grinder while grinding miscellaneous metal parts.

29 CFR 1910.215(d)(1):     Inspection: Immediately before mounting, the wheel was not closely inspected and sounded by the user (ring test) to make sure they have not been damaged in transit, storage, or otherwise.     On or about 12/18/2012, employees from Pasha Distribution Services located at 8050 Veterans Memorial Parkway, St. Peters, MO 63376 were using a Delta bench grinder with a grinding wheel installed, which had not been ring tested prior to mounting/use.
