29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees: (a) Genes Construction @ 3334 Tejon Street, Denver, CO. On or before December 12, 2012, the exposing employer did not ensure that a ladder, ramp or other suitable safe of egress was provided for the employee who was working in the vertically-sided trench, which measured depth was 43 and 5 long. The only means of egress was climbing up the side walls of the trench. This condition exposed employees to a crushing hazard by trench cave-in.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated other materials or equipment at least 2 feet (.61m) from the edge of excavation, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: (a) Genes Construction @ 3334 Tejon Street, Denver, CO. On or before December 12, 2012, the exposing employer did not ensure that the spoil pile was not kept @ least 2 feet from the edge of the vertically-walled trench, which measured depth was 4 3 and 5 ft. in length. This condition exposed employees to the hazard of the spoil pile falling into the trench while conducting work inside the trench.
