29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: A.) Frampton Contracting - On or about 12/17/12, employees were utliizing a hydraulic shoring system in an approximately six (6) foot excavation. The company could not locate the information on the shoring's limitations to depth, width and soil types. This information was not available for the employer to pass on to the employees in training.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): A.) Frampton Contracting - On or about 12/17/12, employees were in excavation up to and including, six (6) feet in depth without cave-in protection being utlilized. The excavations were not sloped, benched nor was any type of protective system in use.
