OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees     Location: 22 East 38th Street, New York, NY     On or about 20 December, 2012     Employer did not ensure that a type A material lift had the proper warning signs and restricted passengers from riding in the elevator.     Abatement Note: among other methods one feasible and acceptable method to correct this hazards is to:     1) Follow the American Society of Mechanical Engineers (ASME) safety code A17.1 (2000), Safety Code for Elevators and Escalators limiting and use by passengers of type A material lift elevators, section 7.5.3.3 and Section 2.16.5.1.1.       2) Follow the American Society of Mechanical Engineers (ASME) safety code 17.1 and follow the required maintenance and repair per Section 8.6.9.  Complete required repairs identified during the annual inspection.
