29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly.    a.  On or about January 10, 2013 - at the above addressed jobsite, employees were lifting large farming equipment using a fabricated lifting device which is attached to the forks of a SKYTRAK 8042 Rough Terrain Forklift.  This practice could affect the capacity of the equipment and the manufacturers written approval was not obtained, thereby exposing the employees to a struck by hazards due to forklift tip over.

29 CFR 1910.178(a)(5): If the truck is equipped with front-end attachments other than factory installed attachments, the user shall request that the truck be marked to identify the attachments and show the approximate weight of the truck and attachment combination at maximum elevation with load laterally centered.    a.  On or about January 10, 2013 - at the above addressed jobsite, employees were lifting large farming equipment using a fabricated lifting device which is attached to the forks of a SKYTRAK 8042 Rough Terrain Forklift. On or about December 26, 2012 - at the above addressed jobsite, operators were not trained in the safe operation of powered industrial trucks, thereby exposing employees to struck by hazards.

On or about December 26, 2012 - at the above addressed jobsite, an employee placed body parts between the mast and the deck of the SKYTRAK 8042 Rough Terrain Forklift which resulted in a fatal injury.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.    a.  On or about December 26, 2012 - at the above addressed jobsite, the employer did not perform daily examinations of the powered industrial equipment, including but not limited to the SKYTRAK 8042 Rough Terrain Forklift, to check for defects, thereby exposing employees to struck by hazards.
