29 CFR 1910.24(b):     Fixed stairs were not provided for access from one structure level to another where operations necessitated regular travel between levels, and for access to operating platforms at any equipment which requires attention routinely during operations:    a) Plant, Tanker Bay Area - Employees accessed the tank platform situated at an elevation of 3.0 ft. 10 in., and the employer did not provide/install a fixed stair.        In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.305(e)(1):     Cabinets, cutout boxes, fittings, boxes, and panelboard enclosures in wet locations were not weatherproof:    a) Plant, Production Area - The facility had batch freezers and four continuous freezers for the production of ice cream. At the time of the current inspection, one of the continuous freezers was disabled due to repairs and only three were in operation.  At the end of the shift employees conducted cleaning/sanitation of the continuous freezers with water hoses. The electrical components including (but not limited to) the junction boxes mounted on the ceiling above the in the ceiling and the boxes and switches on the wall were not waterproof.      b) Plant, Mixing/Pasteurizing Area - Employees conducted cleaning/sanitation of the equipment with water hoses, and the electrical components including (but not limited to) the junction boxes in the ceiling and the boxes and switches on the wall were not waterproof.      Or in the alternative:     29 CFR 1910.303(b)(2):     Listed or labeled electrical equipment was not used or installed in accordance with instructions included in the listing or labeling:    a) Plant, Production Area - Employees conducted cleaning/sanitation of the continuous freezers with water hoses, and the electrical components including (but not limited to) the junction boxes in the ceiling and the boxes and switches on the wall were not waterproof.      b) Plant, Mixing/Pasteurizing Area - Employees conducted cleaning/sanitation of the equipment with water hoses, and the electrical components including (but not limited to) the junction boxes in the ceiling and the boxes and switches on the wall were not waterproof. 29 CFR 1910.22(a)(1):     All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.    a) Plant, Production Area - The concrete floor presented uneven surface, cracks and holes, and was not repaired.    b) Plant, Production Area - The freezer door did not close completely, and ice (from moisture condensation) was not removed from the floor.     c) Plant, Mixing/Pasteurizing Area - The concrete floor presented uneven surface, cracks and holes, and was not repaired.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
