29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards: a) On or about 12/28/12, 237 Dupont Ave., Newburgh, New York the height between the individual trailer loading areas was measured to be over 4 feet above the ground level and was not guarded by a standard railing or toeboard exposing employees to a fall hazard in this commonly used work area.

29 CFR 1910.23(d)(1): Every flight of stairs having four or more risers shall be equipped with standard stair railings or standard handrails as specified in paragraphs (d)(1)(i) through (v) of this section, the width of the stair to be measured clear of all obstructions except handrails: a) On or about 12/28/12 at 237 Dupont Avenue, Newburgh, New York the stairway that provided access to the ground level in the trailer loading area had 4 risers and was not eqipped with a standard handrail in this common work area.
