29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. Excavations were not sloped at an angle not steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal), unless the employer uses other options: a) On December 31, 2012, an employee was working in an unprotected trench that was 8.8 feet deep with near vertical walls in Class C over Class A soils, while preparing to replace a sanitary sewer lateral.
