29 CFR 1926.501(b)(2)(i):   Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.      (a).  On or about December 31, 2012, employees installing roof decking on a 6:12 pitch roof of a two story multi-family residential construction site were not protected by a conventinal or alternative fall protection system to protect them from a 19-foot minimum fall hazard from the eave to the ground below.

29 CFR 1926.1053(b)(1):   Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    (a) On or about December 31, 2012, the extension ladder used by employees to gain access to the roof where they        were working was not extended the minimum 3 feet above the landing to provide safe access and egress preventing        fall hazards.    (b) On or about January 2, 2013, the extension ladder used to gain access to the roof of the two story multi-family           residence that was under construction was not able to be extended above the eave or landing to provide safe access        and egress.
