29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. a) At the site of Hidden Lakes Subdivision, located approximately 0.5 miles south of FM 96 on South Shore Boulevard, in League City, TX: On December 19, 2012, the employer did not ensure excavated spoils were placed at least 2 feet from the edge of an approximately 15 foot deep trench, exposing employees to an engulfment hazard. b) At the site of Hidden Lakes Subdivision, located approximately 0.5 miles south of FM 96 on South Shore Boulevard, in League City, TX: On January 3, 2013, the employer did not ensure excavated spoils were placed at least 2 feet from the edge of an approximately 10 foot deep trench, exposing employees to an engulfment hazard.
