29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    a) Verhoff's Carpet Mart, LLC - Defiance, Ohio: On or about January 3, 2013, employees operated powered industrial vehicles to transport flooring materials in the warehouse and loading areas.  The employer did not assure that employees successfully completed a forklift operator training program containing elements of 29 CFR 1910.178(l) before operating forklifts.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.213(a)(9): All belts, pulleys, gears, shafts, and moving parts were not guarded in accordance with the specific requirements of 1910.219.    a) Verhoff's Carpet Mart, LLC - Defiance, Ohio: On or about December 3, 2013, the employer did not assure the belt pulleys of the planer, which transfer power from the motor of the Craftsman Jointer/Planer, were guarded.  Employees were exposed to hazards created by the rotating parts and nip-points.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.213(d)(1): Circular handfed crosscut table saw(s) were not guarded by an automatically adjusting hood which completely enclosed that portion of the saw above the table and above the material being cut:    a) Verhoff's Carpet Mart, LLC - Defiance, Ohio: On or about December 28, 2012, employees operating the Skilsaw 3310 table saw were exposed to amputation hazards in that the saw was not equipped with a guard.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. The relocatable power strip was not directly connected to a permanently installed branch circuit receptacle.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.37(a)(3): Exit route(s) were not kept free and unobstructed:    a) Verhoff's Carpet Mart, LLC - Defiance, OH: On or about January 3, 2013, the employer did not assure exit routes were free from obstructions.  The exit on the north end of the warehouse was blocked by a carpet roll and a container bin used for carpet rolls.
