29 CFR 1910.1048(d)(1)(i): Each employer who has a workplace covered by this standard shall monitor employees to determine their exposure to formaldehyde.    a) Facility wide- Employer did not perform air monitoring for those employees exposed to formaldehyde. A bulk sample taken for the Diora Keratherapy revealed it contained 4.17% formaldehyde. Personal sampling conducted on 03/13/13 indicated an exposure to formaldehyde at a TWA of 0.082 parts per million (ppm) for the owner conducting the Brazilian Keratin treatment. Sampling was performed for 77 minutes. Zero exposure was assumed for the unsampled period of 403 minutes. The 8- hour TWA for formaldehyde is 0.75. The formaldehyde is released during the blow drying and flat iron application.                  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19.

29 CFR 1910.1048(m)(1)(iii): Employers shall include formaldehyde in the hazard communication program established to comply with the HCS (� 1910.1200). Employers shall ensure that each employee has access to labels on containers of formaldehyde and to safety data sheets, and is trained in accordance with the requirements of HCS and paragraph (n) of this section.  a) Facility wide- Employees apply Diora Keratherapy, which contains 4.17% formaldehyde on client's hair. The employer did not obtain a Material Safety Data Sheet (MSDS) for this product.

The employer shall assure that all employees who are assigned to workplaces where there is exposure to formaldehyde participate in a training program, except that where the employer can show, using objective data, that employees are not exposed to formaldehyde at or above 0.1 ppm, the employer is not required to provide training.  a) Facility wide- The employer did not train those employees exposed or potentially exposed to formaldehyde while using Diora Keratherapy. A bulk sample taken for the Diora Keratherapy revealed it contained 4.17% formaldehyde. Personal sampling conducted on 03/13/13 indicated an exposure to formaldehyde at a TWA of 0.082 parts per million (ppm) for the owner conducting the Brazilian Keratin treatment. 29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  a) Facility wide: The employer did not develop a written hazard communication program for employees exposed to various chemicals in the hair salon such as but not limited to, Keratin Complex Color Treated Shampoo. The condition was noted on 03/13/13.
