29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level.   On or about January 3, 2013, employees were being raised to the roof of the metal building under construction in a man basket attached to a telescoping fork truck without using personal fall arrest equipment as required by the engineer certification, exposing the employee to a fall hazard.  OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falls.  On or about January 3, 2013, employees were exposed to an ejection hazard while being raised in a man basket without using personal fall arrest systems that were attached to the anchor points in the basket.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems.  On or about January 3, 2013, employees were performing roofing work on the metal building under construction up to approximately 20 feet high without fall protection, exposing employees to a fall hazard.
