29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative: a) Lee Road 315 N. Phenix City, AL; On or about December 31, 2012 and at time prior thereto; the employer exposed employees to hazardous energies in that employees were allowed to perform maintenance and servicing on heavy equipment used at a dumpsite without having a energy control program, without being trained in lock out tag out, and without machine specific lock out tag out procedures.

Within eight (8) hours after the death of any employee from a work-related incident or the in-patient hospitalization of three or more employees as a result of a work-related incident, you must orally report the fatality/multiple hospitalization by telephone or in person to the Area Office of the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor, that is nearest to the site of the incident. a) Dumpsite Lee Road 315 Phenix City, AL; On or About December 31, 2012 and at times prior to the employer did not report a workplace fatality within the 8 hour time frame as required by the regulation.

29 CFR 1910.1200(e)(1): Employers did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met: a) Dumpsite - Lee Road 315; On or About December 31, 2012 and at times prior to the employer exposed his employees to hazardous chemicals in that employees were allowed to change hydraulic fluids on dump trucks without maintaining a written hazard communication program, MSD's, and providing the employees with information and training on this chemical and substance as required by the standard.
