29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a) The employer had not developed and maintained a safety and health program to address construction hazards commonly found in residential construction such as but not limited to providing fall protection to employees working at open side or edge of stairwell opening having fall hazards greater than six feet to lower levels.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) On January 3, 2013 an employee who was installing 2 X 4 wood stud wall framing and adding detailed wall bracing to a wall section on a second floor of a new residential single family home structure was not provided with conventional and or personal fall protection to protect against fall(s) through an open stairwell and was exposed to a 10 feet fall to the lower garage concrete floor. b) On January 03, 2013 employees were engaged in a residential construction sheating operation on the floor joist on the third floor were not provided conventional or personal fall protection or alternative fall protection methods and were exposed to fall potentials in excess of 20' feet from the exterior perimeter and the leading edge of the third floor.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) On January 03, 2013 the employer did not ensure that each employee engaged in a residential construction operation of a single family home was trained or knowledgeable in the CFR 1926.501 subpart M fall protection requirements to recognize, minimize, and address fall hazards of six feet and greater associated with unguarded stairwell openings.
