29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) 3115 Shankweiler Rd., Upper roof area - On or about November 23, 2012, an employee was seriously injured in a fall of more than 6 feet, while assisting in operations to replace a shingle roof. No means of fall protection was provided or utilized during the work.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: a) 3115 Shankweiler Rd., Upper roof area - On or about November 23, 2012, an employee was seriously injured in a fall of more than 6 feet, while assisting in operations to replace a shingle roof. No training in fall hazards, or in means and methods to recognize and mitigate those hazards had been conducted by the employer prior to beginning the work.
