29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. On or about December 28, 2012, at the Westlake Chlor-Alkalie Laydown Yard, employees conducting off-loading and loading operations were not trained to coordinate these operations from a designated person capable of observing all conditions, as it had been at times prior.

On or about December 28, 2012, at the Westlake Chlor-Alkalie Laydown Yard, a designated signal person was not maintained to help guide the crane operator in the placement and removal of sea can containers on the flatbed of a truck rig.

29 CFR 1926.1428(a): The employer of the signal person must ensure that each signal person meets the Qualification Requirements (paragraph (c) of this section) prior to giving any signals. This requirement must be met by using either Option (1) or Option (2) of this section. On or about December 26, 2012, and at times prior, a crane signal person was permitted to signal a Manitowoc Crane Operator during loading and off-loading of industrial equipment at the Westlake Vinyls Laydown Yard. The crane signal person was not trained by a qualified evaluator prior to acting as signal person to the Manitowoc Crane operator.
