29 CFR 1926.501(b)(13):     Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):   a) Second floor deck - On or about December 13, 2012, employees were engaged in framing work, no less than 16.4 feet above grade, and were not protected from falling by any means of fall protection.  b) Second floor stairway opening - On or about December 13, 2012, employees were working in the area of the unguarded stairwell opening, no less than eight feet above the lower level, without a using personal fall arrest systems, installing a cover, or having a guardrail system erected around it.

29 CFR 1926.1053(b)(1):     Portable ladders were used for access to an upper landing surface and the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access.    a) Interior stair opening - On or about December 13, 2012, employees were using an adjustable ladder system for access to the second floor that was not capable of extending at least 3 feet above the upper landing surface nor was the ladder secured to same.
