OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed to a fall hazard. On or about 01/08/13 at Mining Gap Rd. Hiawassee, GA: An employee was exposed to a 32' fall hazard while standing on the top rail of the scissor lift. Among other methods, one feasible and acceptable abatement method to correct this hazard is obtain and follow the guidelines set forth in ANSI/SIA A92.61990, Page 21, Paragraph 8.10.1, Personnel Footing. In the alterative 29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. On or about 01/08/13 at Mining Gap Rd. Hiawassee, GA: An employee standing on the top rail of the scissor lift was not provided personal fall protection while exposed to a fall hazard of 32 feet.
