29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace On or about 9 January 2013, and at times prior thereto, the employer did not ensure that employees were medically evaluated to determine the employees' ability to use a respirator. Employees assigned to lead and asbestos contaminated areas wore respirators that had not been medically evaluated to determine their fitness to wear the respirator.

29 CFR 1910.134(f)(8): Fit testing of tight-fitting atmosphere-supplying respirators and tight-fitting powered air-purifying respirators shall be accomplished by performing quantitative or qualitative fit testing in the negative pressure mode, regardless of the mode of operation (negative or positive pressure) that is used for respiratory protection. On or about 9 January 2013, and at times prior thereto, the employer did not ensure that all employees that were provided with a tight-fitting atmosphere supplying respirator, and a tight-fitting, powered air-purifying respirator were fit tested with the assigned respirator by conducting either quantitative or qualitative fit testing in the negative pressure mode.
