29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about January 8, 2013, and at times prior thereto, the employer did not maintain a written hazard communication program and did not maintain Safety Data Sheets for chemicals that were used and stored at the worksite.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  On or about January 08, 2013, the employer did not ensure that employees were provided with training while contractors were working with hazardous chemicals in their work area. The chemicals used at the facility include, but are not limited to, Sherwin Williams Lacquer Thinner and Startex Lacquer Thinner containing Toluene, Light Aliphatic Hydrocarbon Solvent/Naphtha, Acetone, Methanol, and Xylene.
