29 CFR 1926.451(c)(2):     Supported scaffold poles, legs, posts, frames, and uprights did not bear on base plates and mud sills or other adequate firm foundation:    a)  At the jobsite, on the 4th floor, on or about 1/7/13:  Employees were working on a tubular welded frame scaffolding that was constructed without base plates and without mud sills and was placed onto decking made of oriented strand board.  Sections of this scaffold plunged through the deck material which was point loaded and caused two employees to fall 60 feet into an elevator shaft.    Abatement certifiaciton must be submitted for this item.

29 CFR 1926.451(f)(3):     Scaffolds and scaffold components were not inspected for visible defects by a competent person before each work shift, and after any occurrence which could affect a scaffold's structural integrity:    a)  At the jobsite, on the 4th floor, on or about 1/7/13:  Employees were working on a tubelear welded frrame scaffolding that failed and collapsed causing two employees to fall 60 feet into an elevator shaft.  This scaffold was not inspected by a competent person.    Abatement certifiaciton must be submitted for this item.

This scaffold was built in a way to demonstrate that a compentnt person did not supervise the construction.    Abatement certifiaciton must be submitted for this item.

29 CFR 1926.454(a):     The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    a)  At the jobsite, on the 4th floor, on or about 1/7/13:  Employees were working on a tubelear welded frrame scaffolding that failed and collapsed causing two employees to fall 60 feet into an elevator shaft.  The employees who built and worked on the scaffold were not trained to recognize and minimize the hazards that subesequently caused this scaffold to fail. 29 CFR 1926.451(g)(1)(vi):     Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).    a)  At the jobsite, on the 4th floor, on or about 1/7/13:  Employees were working on a tubelear welded frrame scaffolding that failed and collapsed causing two employees to fall 60 feet into an elevator shaft.  Block was being laid to construct the center section of two elevator openings and the openings themselves represented hazards for falling 60 feet into the shaft without fall protection.       Abatement certifiaciton must be submitted for this item.
