29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:    a.  On or about January 9, 2013, at the above addressed jobsite, employees were working with chemicals including, but not limited to crystalline silica.  The employer had not developed and implemented a written hazard communication program including, but not limited to labeling, material safety data sheets and training programs.

29 CFR 1926.501(b)(3): "Hoist areas." Each employee in a hoist area shall be protected from falling 6 feet (1.8 m) or more to lower levels by guardrail systems or personal fall arrest systems. If guardrail systems, [or chain, gate, or guardrail] or portions thereof, are removed to facilitate the hoisting operation (e.g., during landing of materials), and an employee must lean through the access opening or out over the edge of the access opening (to receive or guide equipment and materials, for example), that employee shall be protected from fall hazards by a personal fall arrest system.    a.  On or about January 9, 2013, at the above addressed jobsite, employees in a hoist area were exposed to falls of approximately fifteen (15') feet created by the presence of unprotected window openings, thereby exposing employees to the hazards associated with falls.
