29 CFR 1903.19(c)(1): The employer did not certify to OSHA (the Agency) that each cited violation has been abated within 10 calendar days after the abatement date: S&B Valdovinos Construction did not provide certification on each of the cited items: a) Employees were not wearing fall protection while working from the exterior top plate. b) A portable step ladder in use was not fully open with the side braces in the locked position.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. (a) An employee conducting carpentry operations from the exterior top plate was not protected from falling to the lower level. This exposed the employee to a fall hazard of approximately 12.7 feet.
