29 CFR 1910.132(d)(1):     The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    (a) At the Paradise Landing water park, in the event of occurrence of fecal matter in the pool, Head Guard(s) entered into the pump room and transferred multiple scoops of granular "Power Shock" (concentrated calcium hypochlorite), but the potential hazard associated with eye exposure to this substance had not been adequately assessed.  Eye exposure to this substance could potentially cause corneal damage and impaired vision.

29 CFR 1910.133(a)(1):     Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:    (a) No protective eyewear (such as appropriate safety goggles or safety glasses with side shields) was provided or used when Head Guard(s) handled granular "Power Shock" (concentrated calcium hypochlorite) in response to occurrence of fecal matter in the pool.  Use of such personal protective equipment could prevent injury to the eye(s), which potentially could be caused by exposure to this substance.

29 CFR 1910.1030(c)(2)(i):     The employer having employees with occupational exposure did not prepare an exposure determination:     (a) The employer's "Bloodborne pathogens exposure control plan" did not include an exposure determination for workers having occupational exposure at the Hilton Milwaukee Center facility.  Employees at this facility with occupational exposure to bloodborne pathogens included Life Guards working at the Paradise Landing water park.

29 CFR 1910.1200(f)(5):     The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged, or marked with the identity and appropriate hazard warnings regarding the chemicals contained therein:     (a) Some of the cleaning chemicals used by Life Guards, which were stored at the front desk area of Paradise Landing, lacked required labeling information.  For example, the labeling on a container of air freshener was deficient in that the identity listed on the label (it was labeled as "Mr. Air Fresh") did not match with the identity as listed in its material safety data sheet (identity as listed on material safety data sheet was "Oasis Laundry Fresh Room Refresher" ).  In addition, the container's label lacked any hazard warning information (for example the label did not provide appropriate warning information for this substance, such as: CAUTION! MAY CAUSE EYE IRRITATION).

29 CFR 1910.1200(h)(3)(iv):     Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information:    (a) Trainning provided to the life guards was deficient in that it did not effectively cover how they could access material safety data sheets for the various cleaning chemicals they used, such as (but not limited to) Reflecta  and Oasis Laundry Fresh Room Refresher both of which could cause irritation to eyes and skin.  According to the employer's written hazard communication program, wokers may access to material safety data sheets by phone (by calling 3E Company) or by internet at the 3E Company's website.  However, life guards had not been provided with the necessary training regarding these methods of obtaining appropriate hazard information.
