29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): 1.) On or about January 10, 2013 the employer did not ensure that an employee operating the Nasco forklift is competent to complete the task. The employer did not ensure that the forklift operator received formal instructions and practical training on how to operate a powered industrial vehicle, as well as evaluate the operator's performance.
