Employees were exposed to chemicals such as, but not limited to, dust generated when mixing and using mortar containing Portland cement.

29 CFR 1926.300(b)(2): Moving part(s) of equipment exposed to contact by employees or which otherwise created a hazard, were not guarded:    On or about January 9, 2013, employees were exposed to struck-by hazards when guards on the portable concrete mixer were missing.  The cover over the motor was missing, a hole had been cut in the side of the motor housing near the belts, and part of the guard over the top of the mixing bowl was missing.

On or about January 9, 2013, employees were exposed to fall hazards of approximately 12-18 feet when there was no ladder to access the scaffold while the employees were on the scaffold moving bricks.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).    On or about January 9, 2013, employees were exposed to fall hazards of approximately 12-18 feet when there were no guardrails on the second and third scaffold levels while the employees were on the scaffold moving bricks.
