OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to the hazard(s) of falling and/or being thrown from a powered industrial truck:   a)  At the warehouses - on or about January 10, 2013, and at times prior to employees were allowed to use a Daewoo G 25E forklift to elevate employees with an unapproved platform such as, but not limited to a 4-foot X 4-foot wooden pallet to stack boxes onto the top storage rack.  The manufacturer of the Daewoo G 25E forklift does not allow this model to elevate personnel, and the unapproved work platform was not designed in accordance with ANSI/ITSDF B56.1, thus exposing employees to fall, crush-by and struck hazards.     AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS AS FOLLOWS: 1. With the approval of forklift manufacturer, the purchase of a proper safety work platform meeting the specifications of American National Institute Standard/Industrial Truck Standards Development Foundation (ANSI/ITSDF) B56.1-2009 or update to be used as stipulated in paragraph 4.17, Elevating Personnel.   2.   With the approval of the forklift manufacturer, the in house fabrication (certified by a professional engineer) of a proper safety platform meeting the specifications of American National Institute Standard/ Industrial Truck Standards Development Foundation (ANSI/ITSDF) B56.1-2009 or update to be used as stipulated in paragraphs 4.17, Elevating Personnel and 7.37, Platforms: Elevating.      ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides,  a)  Warehouses - on or about, and at times prior to January 10, 2013, the employer did not ensure employees who worked at a height of 10 feet while stacking and/or removing boxes from the top storage racks were provided with some form of fall protection such as, but not limited to, personnel fall arrest systems, restraint systems, or work platforms with standard guardrail systems attached were exposed to struck-by and fall hazards.      ABATEMENT CERTIFICATION IS REQUIRED

29 CFR 1910.26(c)(3)(vii): Ladders should not be used as a brace, skid, guy or gin pole, gangway, or for other uses than that for which they were intended, unless specifically recommended for use by the manufacturer.   a) Inside the warehouse, on or about January 10, 2013 and at times prior to, employees used a stepladder while the ladder was closed, to access the metal storage rack to stack boxes, exposing employees to fall hazards. 29 CFR 1910.37(a)(3): Exit routes must be free and unobstructed. No materials or equipment may be placed, either permanently or temporarily, within the exit route. The exit access must not go through a room that can be locked, such as a bathroom, to reach an exit or exit discharge, nor may it lead into a dead-end corridor. Stairs or a ramp must be provided where the exit route is not substantially level.   a) At the back exit door of the warehouse area, on or about January 10, 2013 and at times prior to, boxes that was stacked in front of the emergency exit doorway obstructed egress, exposing employees to burns and smoke inhalation hazards. 29 CFR 1910.37(b)(6): Each exit sign must be illuminated to a surface value of at least five foot-candles (54 lux) by a reliable light source and be distinctive in color. Self-luminous or electroluminescent signs that have a minimum luminance surface value of at least .06 footlamberts (0.21 cd/m2) are permitted.   a) Main Building, warehouse - on or about January 10, 2013, employees were exposed to fire hazards while working in several areas of the building where the exit sign for the designated exit door was broken off and not illuminated, exposing employees to burns or smoke inhalation hazards.
