OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of being struck by a moving excavator or the rotating superstructure or the boom or bucket of an excavator: A) South side of job site, on or about January 9, 2013, a Komatsu excavator did not have an operable horn, exposing employees to a struck by hazard.
