29 CFR 1910.178(l)(4)(iii) as referenced by 29 CFR 1915.120: An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years. a.) EMS Industrial Inc., Shop Area, Caterpillar Forklift, Serial No. AT-8700-599, Type LP, Capacity 8000 lbs., Model 6040K-STR. On or about January 10, 2013, the employer did not conduct a performance evaluation every three years for each operator of the powered industrial truck used in the shop and yard areas. EMS Industrial Inc., was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard which was contained in OSHA Inspection Number 309732253, Citation 2, Item 2, issued on May 27, 2009.

29 CFR 1910.303(b)(2): Installation and use. Listed or labeled equipment shall be installed and used in accordance with any instructions included in the listing or labeling. a.) EMS Industrial Inc., Superintendent's cubicles, 2nd floor, Relocatable Power Tap, Model BB-05, 125VAC, 15A max load. On or about January 10, 2013, an energized re-locatable power tap, with six (6) outlets, was not being used as to its listed and labeled purpose in that a Haier portable refrigerator (Model BC1117LW, Serial No. D2002625665, 115V) and an Emerson microwave (Model No. MT3060, 120V, 600w-1050w) were plugged into the unit. b.) EMS Industrial Inc., Shop, Break Area, American Power Conversion (APC) re-locatable power tap, UL1363, 120V, 15amp, 50/60Hz. On or about January 10, 2013, an energized re-locatable power tap with seven (7) outlets, was not being used as to its listed and labeled purpose in that two large vending machines were plugged into the unit.
