(b) Brandywine Senior Living, 311 Route 73, Voorhees, NJ: Employee of a subcontractor of Mega Construction was exposed to an approximate 19' fall while working from an aerial lift without the use of fall protection, observed 12/28/12.    Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated     NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

(a) Jobsite located at Brandywine Senior Living, 311 Route 73, Voorhees, NJ, Second Floor: An employee exposed to an approximate 22' fall to the floor below while installing toekicks and adjusting the guardrail system was not protected against falling - top rail approximately 37" high, observed on or about 3/5/13.    NOTE:  BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.
